北京市住房和城乡建设委员会关于做好工程建设项目审批制度改革试点工作的通知

  各区住房城乡建设委、东城、西城区住房城市建设委、经济技术开发区建设局:

  为切实落实好《国务院办公厅关于开展工程建设项目审批制度改革试点的通知》(国办发〔2018〕33号)、《北京市工程建设项目审批制度改革试点实施方案》(京政办发〔2018〕36号)等文件精神,进一步做好建设项目审批制度改革试点工作,提升“放管服”水平,现将有关工作要求通知如下:

  一、各建设行政主管部门对建设项目新申办建筑工程施工许可证的,要严格执行《国务院办公厅关于开展工程建设项目审批制度改革试点的通知》(国办发〔2018〕33号)、《北京市工程建设项目审批制度改革试点实施方案》(京政办发〔2018〕36号)要求,精简审批前置要件。

  二、建设项目新申办建筑工程施工许可证的,取消“建设单位项目资金落实证明文件”,由建设单位出具《建设项目法人承诺书》,承诺项目建设资金已经落实。

  三、取消建设项目施工合同备案。

  四、将工程质量监督注册、工程施工安全监督备案和建设工程施工许可证核发合并办理。建设单位除提交施工许可申报材料外,无需再提交其他材料。施工许可证核发后,信息系统平台将相关信息推送给质量和安全监督管理部门。

  五、建设单位需承诺施工图设计文件符合国家标准规范,新建扩建项目、现状改建项目应在底板施工前取得审查合格书;内部改造项目、市政基础设施项目应在正式施工前取得施工图审查合格书。

  六、严格落实施工许可审批时限要求,对于符合法定要求的,自受理之日起5个工作日内应当完成施工许可证审批工作。

  七、各建设行政主管部门要结合试点工作推进情况持续开展宣传引导和政策解读,做好改革措施的宣传、培训和服务工作,通过多种形式及时宣传试点工作的改革措施和取得的成效。

  八、本通知自发布之日起实施。

Notice of the Beijing Municipal Commission of Housing and Urban-Rural Development on

Effectively Implementing the Pilot Program of the Reform of

the Approval System for Construction Projects

Jing Jian Fa [2018] No. 470

Commissions of Housing and Urban-Rural Development of various districts, Commissions of Housing and Urban Development of Dongcheng and Xicheng districts, and Construction and Development Bureau of Beijing Economic-Technological Development Are:

      To effectively implement the spirits of the Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33) and the Implementation Plan of Beijing Municipality for the Pilot Program of the Reform of the Approval System for Construction Projects (Jing Zheng Ban Fa [2018] No. 36), further optimize Pilot Program of the Reform of the Approval System for Construction Projects and improve the level in “the reform of delegating powers, improving regulation and optimizing services”, the Beijing Municipal Commission of Housing and Urban-Rural Development hereby notifies the related matters as follows:

      1. When handling new application for construction permits for construction projects, all administrative departments competent for construction shall strictly comply with relevant requirements in the Notice of the General Office of the State Council on Launching the Pilot Program of the Reform of the Approval System for Construction Projects (Guo Ban Fa [2018] No. 33) and the Implementation Plan of Beijing Municipality for the Pilot Program of the Reform of the Approval System for Construction Projects (Jing Zheng Ban Fa [2018] No. 36) and streamline the preconditions for approval.

      2. In the event of any new application for the new construction permit for the construction project, the “proof of funds availability by the construction unit” is cancelled where the construction unit is required to present the “Legal Person Commitment for Construction Projects” to promise that the funds for the construction project are well available.

      3. Filing of the construction contract for the construction project is cancelled.

      4. The applications for the Quality Supervision Registration, the Construction Safety Supervision Filing and the Construction Permit for Construction Project will be examined and issued concurrently. The construction unit is no longer required to submit any other materials other than the application materials for construction permission. Once the construction permit is approved and issued, the information system platform will push relevant information to administrative departments competent for quality and safety supervision.

      5. The construction unit shall undertake that its construction drawing design documents comply with national standards and regulations and the Certificate of Compliance shall be obtained before the base plate construction of any new or expansion project or reconstruction project; the Certificate of Compliance of Construction Drawings shall be obtained before the formal construction of any internal renovation project or municipal infrastructure project.

      6. The time limit for the approval of construction permission shall be strictly observed. For any legible project, the examination and approval of the construction permit shall be completed five working days from application acceptance.

      7. All administrative departments competent for construction shall consistently carry out publicity, guidance and policy interpretation on the basis the pilot program progress and do a good job in propaganda, training and service of the reform measures by publicizing, through multiple channels, the reform measures and achievements of the pilot work.

      8. This Notice will come into force as of the date of promulgation.
